Certain services may be subject to weather conditions, location access restrictions, airspace regulations and other factors outside reasonable control. Where such circumstances arise, reasonable efforts will be made to provide alternative solutions or reschedule content creation where appropriate.

4. Deposits and Bookings

For commissioned projects, a booking deposit may be required to secure dates and availability.

Unless otherwise agreed in writing, a non-refundable deposit of 25% of the agreed project value may be requested prior to work commencing.

Remaining payment terms will be outlined within the relevant project agreement.

Failure to make payments in accordance with agreed terms may result in suspension or cancellation of services.

5. Licensing and Content Usage

Unless otherwise agreed in writing, copyright in all commissioned photography and videography remains with Josh Robinson.

Clients are granted usage rights only as specified within their project agreement.

Commercial use, advertising use, publication, resale, redistribution or sublicensing of content is prohibited unless expressly licensed in writing.

Additional licensing may be purchased where required.

6. Portfolio and Promotional Use

Unless otherwise agreed in writing, we reserve the right to display commissioned work for legitimate promotional purposes, including:

  • Portfolio display

  • Website content

  • Social media

  • Marketing materials

  • Industry awards

  • Publications and exhibitions

Any confidentiality requirements must be agreed before project commencement.

7. Failure to Perform

In the unlikely event that Josh Robinson is unable to perform agreed services due to illness, injury, emergency, equipment failure or other circumstances beyond reasonable control, reasonable efforts will be made to reschedule the project or identify a suitable alternative solution where appropriate.

Where services cannot be delivered and no alternative arrangement can be agreed, liability shall be limited to the refund of any payments made for the affected services. This shall constitute the full extent of liability.

8. Force Majeure

We shall not be liable for failure or delay in performing obligations where such failure results from circumstances beyond reasonable control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Government restrictions

  • Pandemic or public health emergencies

  • Transport disruption

  • Power failures

  • Civil unrest

  • Acts of terrorism

  • War

In such circumstances, reasonable efforts will be made to reschedule services where possible.

9. Limitation of Liability

While every reasonable effort is made to provide services to a professional standard, Josh Robinson shall not be liable for any indirect, consequential or incidental losses arising from the use of this website or the provision of services.

To the fullest extent permitted by law, total liability for any claim arising from services provided shall be limited to the amount paid by the client for those services.
